SUPREME COURT OF PAKISTAN DECISION - SALARY OF ANY EMPLOYEE CANNOT BE WITHHELD AS A PUNISHMENT

The Supreme Court of Pakistan issued an order / decision of writ regarding withholding the salary of employees as punishment.


  • We have partly heard the learned Counsel for the Appellants and the learned Law Officers. We are informed that in certain parts of Balochistan, the salaries have not been paid to the teachers for the Iast 3 o 4 months. The Deputy Secretary, Education Department, present in Court, states that a detailed report will be filed by the department in this respect before the next date of hearing. However, we make it clear that salary of an employer cannot be withheld as a punishment and if a person is found guilty of the misconduct as contemplated under the Balochistan Civil Servants Act / Rules, the department shall proceed.

CIVIL SERVANTS EFFICIENCY AND DISCIPLINE RULES 2020

  Government of Pakistan, Cabinet Secretariat (Establishment Division) made Civil Servants Efficiency and Discipline Rules, 2020.  Prime Minister approved to make the following rules:-  1.
